Chapter 1. General Rules
Articel 1 (Purpose)
The purpose of these Terms and Conditions is to set forth the rights, obligations, and duties between the NHN Ticketlink and its users with respect to the customer sign-up process and the use of the services operated by NHN Ticketlink Corporation (hereinafter referred to as “NHN Ticketlink” or the “Company”).
Articel 2 (Posting and Modification of Terms and Conditions)
1. NHN Ticketlink shall post the content of these Terms and Conditions, the Company’s trade name, the address where its business place is located, the name of its representative director, business registration numbers, contact information (phone numbers, fax transmitter numbers, e-mail addresses, etc.) on the start-up screen of the services or share with users via other methods to ensure that users can easily see the information.
2. NHN Ticketlink may amend the Terms and Conditions to the extent permitted by related legislation including the Regulation of Standardized Contracts Act, the Framework Act on e-Commerce, the Digital Signature Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., Act on Door-to-Door Sales, etc. and Act on the Consumer Protection in Electronic Commerce, etc.
3. In the event that the Company modifies these Terms and Conditions, it shall specify and post on the start-up screen for the services the date of application and the reasons for modification together with the current Terms and Conditions from seven (7) days before the date of application; provided, however, that where these Terms and Conditions are modified unfavorably against the users, the content shall be notified with a prior grace period of at least no less than thirty (30) days.
4. Should NHN Ticketlink amends the Terms and Conditions, the amended terms shall only be applicable to the agreement signed after the effective date and the provisions in existing Terms and Conditions before the amendment shall be applied to the already signed agreements. However, if a user who had already signed an agreement wishes his/her agreement to be applied with the amended Terms the user shall deliver his/her will to the Company within the notification period of the amended Terms and Conditions as stipulated in Section3 and acquire the approval from the Company in order to be applied with the revised provisions.
5. Any matter that is not provided in these Terms and Conditions or any interpretation of this agreement shall follow the Guidelines for Consumer Protection in Electronic Commercial Transactions set forth by the government, and relevant laws or commercial practices.
Article 3 (Definitions)
1. “NHN Ticketlink” refers to the virtual business site set to allow the trade of goods or services through information and communication facilities such as computers in order for NHN Ticketlink Corporation to provide goods and services to its users and it shall also mean the party operating the NHN Ticketlink internet website.
2. “Users” shall refer to members and non-members who have access to the service operated by NHN Ticketlink and receive the services provided by the NHN Ticketlink.
3. "Buyer” means any User who shows his/her intent to purchase product or services in accordance with the online forms provided by the Company.
4. “Member” shall mean a person who falls under any of below items.
(1) “Paid Members” shall refer to persons who have provided their personal information to the NHN Entertainment Corporation (hereinafter “NHN Entertainment”) which is the company that shares the Member information with NHN Ticketlink and registered their membership for the Services, and who can be continuously provided with information of the Services upon paying the annual fee and continue to use the Services provided by the Company.
(2) “General Members” shall mean those who has signed up as a member upon providing their personal information to NHN Entertainment which is the company that shares the Member information with NHN Ticketlink, and who can be continuously provided with information of the Services without paying the annual fee and continue to use the Services provided by the Company
(3) “Partner Members” shall mean the members of the partnering company which has established partnership with NHN Ticketlink and provided the minimum information (name, address, phone number) of its members required for ticket reservation to NHN Ticketlink to allow its members to use the Services of NHN Ticketlink. The Partner Member credit card and other membership card can be issued to those who have agreed in prior via phone call or mail to be issued with the partner card when partnering with credit card, shopping mall and insurance company. The standard for issuance shall follow the issuance review criteria of both NHN Ticketlink and the partnering company.
5. “Non-members” shall mean those using the service provided by NHN Ticketlink without signing up as a member.
6. “PAYCO Members” shall mean those approved by NHN Entertainment after agreeing to the PAYCO Membership Terms of Use of NHN Entertainment and applied for the service use.
7. “ID” means email address or mobile numbers chosen by a user, granted by “NHN Entertainment’ which is the company that shares the member information with NHN Ticketlink, for purposes of identification and use of the Services.
8. “Password” means a combination of letters and numbers chosen by a User to verify the User’s identity and protect the Member’s rights, interests and confidential information.
9. "Admin” is the person selected by NHN Ticketlink for an overall management and seamless operation of NHN Ticketlink services.
10. “Unsubscribe” means to terminate the use of the Service after User signs up to NHN Ticketlink Service.
Chapter 2 Service Use Agreement
Article 4 (Application for Use)
1. A User shall apply for membership subscription by giving his or her manifestation of intention to consent to these Terms and Conditions after entering the membership information according to the subscription form prescribed by NHN Ticketlink.
2. NHN Ticketlink shall register Users who have applied for membership subscription under Section 1 unless a User falls under each of the following items:
(1) In the event that a subscription applicant has ever lost his or her prior membership qualifications under Article 9 Section 3 in Chapter 3 of these Terms and Conditions provided, however, that exceptions shall be made where three (3) years has lapsed after a user has lost his or her membership qualifications under Article 9 Section 3 in Chapter 3 and the user has obtained approval of re-subscription from NHN Ticketlink.);
(2) When the User is not a PAYCO member;
(3) In the event that there are false information, omitted information, or mistaken entries in the registered matters; or
(4) In the event that a User’s membership registration is found to seriously affect NHN Ticketlink’s technologies.
3. An agreement for membership subscription shall be formed at the time when approval by NHN Ticketlink arrives at a User.
4. In the event that there is a change in the registered matters, according to Section 1 Article 10 in Chapter 4, provided to the Company, the Member shall forthwith notify NHN Ticketlink of the change(s) by e-mail or in any other way.
5. According to the related legislation, users under the age of 14 may use the service only after going through an additional agreement process by one’s legal representative aside from completing the subscription form set by NHN Ticketlink.
Article 5 (Conclusion of the Service Use Agreement)
1. The Service Use Agreement is concluded by the approval of NHN Ticketlink after a User signs up as PAYCO member, consents to the Terms and application for use and applies for subscription.
2. In any of the following cases, NHN Ticketlink may not approve the User’s application for use:
(1) When the capacity of the service-related equipment is insufficient
(2) When there are technical errors
(3) If the application is made with a third party’s identity
(4) If the application is made by non-PAYCO member
(5) If the User had submitted false information during one’s application for service use
(6) If a user whose age is below 14 has failed to acquire the approval from his/her legal representative including parents
(7) If the application is submitted with the purpose of disturbing the peace in society or beautiful and fine customs
(8) If the User failed to meet the criteria for application set forth by NHN Ticketlink.
Article 6 (Memberships and Annual Dues)
1.The Members are classified into Paid Member, General Member and Partner Member.
(1) General Members refer to those who do not pay annual fee.
(2) Paid Members refer to those who pay annual fee and are eligible for receiving various benefits provided by NHN Ticketlink.
(3) Partner Members refer to the members of the company that has entered into partnership with NHN Ticketlink and the services that the Partner Members receive are flexible depending on the agreement conditions.
2. The annual fee can be paid via payment method designated by NHN Ticketlink.
3. The refund of annual fee is available only within the period (within seven (7) days including the day when the fee was paid) set by NHN Ticketlink. (However, if there is any reservation made with Paid Member status upon signing up as the Paid Member, the refund will not be available.)
However, as for certain partnering products, the refund will not be available even though it had not been used upon purchase according to the policy set by partnering company.
4. The amount and change of annual fee shall follow the membership policy of NHN Ticketlink.
Article 7 (Period of Membership)
1. The membership period for General Member shall be from the time when the Service Use Agreement is concluded until the termination of agreement from the User’s will.
2. The membership period of Paid Member is for one (1) year from the submission of annual dues and the extension of said period shall be completed through paying the annual fee in the method stipulated in Section 2 Article 6 in Chapter 2. Failing to extend the membership period shall automatically change the membership status from Paid Member to General Member.
Article 8 (Change of Agreement Conditions)
1. If there is any change made to the information submitted during Member’s application for use, he/she shall modify the information online.
2. Any loss inflicted from failing to abide by the provision in above section shall not be covered by NHN Ticketlink.
Chapter 3 Termination of Agreement and Restriction on Service Use
Article 9 (Withdrawal from Membership and Disqualifications)
1. Members may at any time request NHN Ticketlink of their withdrawal from membership, and NHN Ticketlink shall forthwith handle the withdrawals from membership according to the provision on membership withdrawal.
2. In the event that a Member falls under each of the following reasons, NHN Ticketlink may restrict or discontinue his or her membership qualifications:
(1) In the event that a Member has registered false information at the time of applying for membership;
(2) In the event that a Member has not paid amounts for goods and services, etc. purchased by use of the online website of NHN Ticketlink or any other liabilities payable by the Member with respect to use of NHN Ticketlink;
(3) In the event that a Member threatens the order of electronic commercial transactions by obstructing third parties’ uses of NHN Ticketlink or misappropriating the information; or
(4) In the event that a Member engages in activities that are prohibited under the laws or these Terms and Conditions, or are against the public orders and good morals by using NHN Ticketlink; or
3. In the event that after the Company has restricted or suspended the membership qualifications for a Member, the Member repeats the same activity no less than twice or the reason is not corrected within thirty (30) days, the Company may forfeit the membership.
4. In the event that the Company has forfeited the membership qualifications, it shall cancel the membership registration. In this case, the Company shall notify the Member thereof and provide an opportunity to explain away before cancellation of the membership registration.
5. The refund of annual fee from withdrawal of Paid Membership shall be done according to a process stipulated in Section 3 Article 6.
Chapter 4 Duties of Agreement Parties
Article 10 (Protection of Personal Information)
1. NHN Ticketlink shall collect the minimum information required to perform a purchase agreement in collecting information of Users in accordance with related legislation including Act on Promotion of Information and Communication Network Utilization and Information Protection, etc. as well as Privacy Policy and shall not use the collected personal information beyond the initial purpose without acquiring the consent from the User or provide to a third party.
2. NHN Ticketlink shall designate and operate a minimum number of Admins for the protection of personal information and shall not be liable for any loss inflicted upon its Users from loss, theft and leakage of such personal information, including the credit card and bank account, arisen from the reason attributable to the Users.
3. NHN Ticketlink shall post its Privacy Policy regarding the protection and management of the Users’ information on its webpage for the Users to clearly understand.
Article 11 (Duties of NHN Ticketlink)
1. NHN Ticketlink shall not engage in any activity that is prohibited under the laws or these Terms and Conditions or against the public orders and good morals, and shall use its best efforts to provide the goods or services continuously and securely as set forth under these Terms and Conditions.
2. NHN Ticketlink shall have a security system for personal information protection for users (including credit information) to ensure that users can safely use the internet services.
3. " In the event that NHN Ticketlink has caused damages to users by its engaging in unreasonable labeling or advertising activities prescribed in Article 3 of [the Fair Labeling and Advertisement Act] with respect to its goods or services, it shall compensate for the damages.
4. NHN Ticketlink shall not send advertising e-mails for profitable purposes unwanted by users.
Article 12 (Duties of Members for IDs and Passwords)
1. Members shall have the obligation to have their IDs and passwords under control except for the case stipulated in Section 3, Article 10 in Chapter 4 and any civil and criminal responsibility arising out of one’s negligence to do so shall vest in the Member him/herself.
2. Members shall not cause a third party to use their own IDs or passwords.
3. In the event that a Member has been aware that his or her ID or password has been stolen or is being used by a third party, the Member shall forthwith notify NHN Ticketlink thereof, and follow the directions of NHN Ticketlink, if any.
Article 13 (Duties of Members and Users)
1. Users should abide by the related legislation, provisions in these Terms and Conditions, use guidelines and public notifications by NHN Ticketlink and shall not implement activities harming the company’s business.
2. Users shall not engage in the following activities with regards to the Service use;
(1) To register false information at the time of applying for or changing the content of membership;
(2) To change information posted in NHN Ticketlink without acquiring permission;
(3) To transmit or post information other than the information set forth by NHN Ticketlink (including computer software);
(4) To infringe upon intellectual properties, including NHN Ticketlink, any other third party’s copyrights;
(5) To undermine the reputation of or obstruct businesses of NHN Ticketlink or third parties; or To disclose or post on NHN Ticketlink obscene or violent messages, videos, voices, and any other information that is against the public orders and good morals.
(6) Other activities requested correction by Korea Internet Safety Commission
Article 14 (Formation of Agreement)
1. NHN Ticketlink may accept an application for purchase in Article 16 in Chapter 5 unless it falls under any of the following items:
(1) In the event that the registrations have false, omitted, or mistaken information;
(2) In the event that a minor purchases goods or services prohibited under the Juvenile Protection Act; or
(3) In the event that the Company’s acceptance of a purchase order is found to seriously affect the Company’s technologies.
2. A purchase application in above section shall be deemed formed at the time when acceptance by the Company arrives at a User in the notification form of receipt confirmation in Article 27 Chapter 7.
Chapter 5 Regulations on Payment
Article 15 (Available Payment Methods)
The payment methods for the goods or services purchased through NHN Ticketlink shall be as described in each of the following items.
(1) Deposit without bankbook;
(2) Credit card;
(3) Account transfers;
(4) Advance ticket;
(5) Mobile phone payment;
(6) Gift voucher;
(7) Other payment means found acceptable by NHN Ticketlink
Article 16 (Application for Purchase)
Users shall apply for purchase in the manner prescribed in NHN Ticketlink.
(1) ‘Account login’ for Members and enter minimum information (name, mobile phone numbers, date of birth (on the resident registration card))’ for purchase and identification;
(2) Select the goods or services;
(3) Select payment method
(4) Agree to the Terms (ex. Clicking mouse)
Chapter 6 Service Use
Article 17 (Provision of Information)
NHN Ticketlink may provide to a Member various information that it deems necessary for the Member’s use of Services via mail or email, etc.
Article 18 (Member’s Posting)
NHN Ticketlink may, without prior notice, remove any service contents posted or registered by a Member in the following cases:
(1) If such contents slander or damage reputation of other Members or any third parties
(2) If such contents are against public order and traditional custom
(3) If such contents are deemed to be related to any criminal act.
(4) If such contents infringe any rights of the Company or any third parties such as copyrights
(5) If such contents have been posted beyond the period set by the Company
(6) If the Member posts obscene materials on the NHN Ticketlink sites or boards or links to such materials
(7) If such contents are deemed to violate related legislation
Article 19 (Copyrights of the Posting)
1.The rights and responsibilities to the postings shall vest in the person who had uploaded the contents and NHN Ticketlink shall not use said material for profit making purposes other than posting in the website without acquiring the consent from the writer. However, in case the purpose is non-profit, it shall be considered exception and NHN Ticketlink shall hold the right to post in website.
2. The Member shall not commercially use the material uploaded in the Services such as processing or selling the said information.
Article 20 (Service Time)
1. In principle, the Services shall be available 24 hours a day, 7 days a week, 365 days a year unless it is interrupted by technical issues or other matters of NHN Ticketlink, however, excluding any times or days designated by Company such as any shutdown period necessary for routine maintenance of the Services.
2. NHN Ticketlink may divide the Services into parts and set separate Service times for each part of the Services, which shall be announced in advance.
Article 21 (Responsibilities for Service Use)
Members shall not engage in business activities, selling goods using service, unless concretely permitted in a written form signed by the party having the authority granted by NHN Ticketlink and he/she may not permit commercial activity or illegally distribute commercial software through hacking, profit-generating ads and obscene website. Any legal sanctions posed on the violator including imprisonment by related organization as well as result of the business activity and loss arisen from violating such provision shall not be covered by NHN Ticketlink.
Article 22 (Suspension of Provision of the Services)
1. NHN Ticketlink may suspend the provision of the Services if any of the following cases occur.
(1) If the suspension is inevitable from reasons including repairing the facility for service;
(2) If the key telecommunications business operator stipulated in Telecommunications Business Act has suspended the telecommunications service;
(3) If the reason is due to an act of God or a force majeure event.
2. NHN Ticketlink may limit or suspend all or part of the Service if the use of normal service is hampered from reasons including state of national emergency, power failure, error in service facility or surge in traffic to the Service.
Article 23 (Notifications for Members)
1. In the event that the NHN Ticketlink gives a notice to Members, it may do so with the e-mail addresses provided to NHN Ticketlink by the Members.
2. In the event that NHN Ticketlink gives a notice to unspecified and many users, it may replace individual notifications with posting the notifications on the website for no less than one (1) week.
Chapter 7 Reservation Service, Delivery, Cancellation and Refund
Article 24 (Offer of Reservation Services
NHN Ticketlink provides the reservation Services for shows, exhibitions, sports, leisure, events, etc., via phone, internet and reservation sites, and availability of such Services depends on the type of reservation Services selected by the User, payment methods, and delivery methods, which shall be governed by the Terms of Use in NHN Ticketlink’s webpage site.
Article 25 (Reservation Fees)
1. NHN Ticketlink charges reservation fees for using the reservation Services that NHN Ticketlink offers. For the reservation of shows, exhibitions, sports, leisure activities and events, different fees are charged depending on the membership classes (General/Paid Member) and the reservation methods (internet/call center). The Company’s policy for the reservation fees may be amended after the notice to the Members pursuant to Article 23.
2. Unless otherwise provided per each event, notwithstanding the cancellation pursuant to Article 29, the reservation fees are non-refundable except for the day of reservation.
Article 26 (Delivery of Tickets)
1. With regard to the products purchased by the User, NHN Ticketlink indicates the delivery methods, a party responsible for the delivery fees per each delivery method, and the delivery period per each delivery method, etc. If it is delivered beyond said delivery period for reasons attributable to the Company’s negligence or intentional act, the Company shall indemnify the Users harmless from any damages incurred therefrom.
2. The delivery period is set as follows: the products are dispatched the day after the payment for the products are made (for credit card and deposit online, the day after the confirmation of such payment) and a standard arrival date of ten (10) days therefrom (including delivery to regional areas) applies. However, for some purchased goods, a separate delivery principle may be applied such as collective delivery on a specific day.
3. The delivery situation is subject to change on Saturday, holidays and the delivery process and shall follow the guidelines stipulated on NHN Ticketlink’s webpage. The delivery fee for the ticket shall be borne by the User and such fee shall be set according to the criteria defined by NHN Ticketlink based on the management and personnel expenses.
4. The Buyer may cancel his/her purchase before it is set out for delivery and if the item is being delivered, he/she shall follow the return process of NHN Ticketlink.
Article 27 (Notice of Receipt Confirmation, Cancellation of Purchase Request)
1. In the event of the purchase request made by the User, the Company shall notify the User of a receipt confirmation.
2. Where there is no meeting of the minds, the User notified of such receipt confirmation may, immediately upon receipt thereof, may request cancellation of the purchase request.
3. Upon the User’s request for the cancellation of the purchase request before delivery of the products, the Company shall comply with such request without delay.
Article 28 (Refund, Return and Exchange)
1. If the Company finds that it is unable to provide the products or the services ordered by the User because such products are out of stock or the services are unavailable, it shall notify the User of the reasons therefor without delay. If any advance payment for such products or services has been made, such payment shall be refunded or any procedure required for such refund shall be taken within the Company’s three (3) business days.
2. NHN Ticketlink shall refund, return or exchange the product delivered upon the User’s request within one (1) business days upon receiving the item sold, even though the item has already been delivered, in any of the following cases:
(1) If the delivered items are different from the order made or the information NHN Ticketlink provided
(2) If the delivered products are destroyed, damaged or contaminated
(3) If the items arrived later than the delivery period stipulated in the advertisement
(4) If the User had made the reservation for a concerned item without the matters that need to be displayed in the ads being inserted according to Article 18 in the Door to Door Selling Act
Article 29 (Cancellation or Refund of Reserved Tickets)
1. The Buyer may cancel or refund tickets reserved prior to the cancellation deadline for shows/sales.
2. The standard for sales/cancellation deadlines shall follow the contents stipulated in ‘Getting Started’ section in NHN Ticketlink website.
3. The sale and cancellation deadlines in the preceding Section are subject to change according to the circumstances of event hosts.
4. The Buyer may cancel the reserved tickets only through the reservation channel he/she had used for the reservation.
5. The Company charges cancellation fees when cancelling the reserved tickets for shows, exhibitions, sports, leisure activities and events and the Company’s policy for the cancellation fees may be amended after notice to the Users pursuant to Article 23. If the User had opted for deposit without bankbook, a minimal amount of remittance charge could be deducted.
6. If the tickets for show, exhibition and sports activities are cancelled within seven (7) days from the date of the reservation, the Company shall not charge any cancellation fees in accordance with relevant laws. However, if the cancellation is made within ten (10) days from the show day, the provision defined in Section 10, Article 37 shall prevail.
7. In the event of the cancellation for the period other than one provided in Section 6, the relevant cancellation fees to be deducted are fixed depending on each product and service, and the cancellation fee policy is subject to change after prior notice thereof given according to the Article 23; provided, however, that unless otherwise provided, the standards below apply.
8. Notwithstanding Section 6, if the cancellation time corresponds to the time set by consumer dispute resolution standards, the remedies pursuant to consumer dispute resolution standards apply.
9. If any cancellation occurs no less than ten (10) days prior to events concerned, the following cancellation fees are charged:
- The tickets for events such as musicals, concerts, classical concerts, etc.: 4,000 KRW
- The entrance tickets for play, exhibitions, etc.: 2,000 KRW
- Such cancellation fee shall not exceed 10% of the purchase price
10. If any cancellation occurs no less than ten (10) days prior to show/exhibition concerned, the following cancellation fees are charged
- Seven (7) days before the show : 10% of the ticket price
- Three (3) days before the show: 20% of the ticket price
- One (1) days before the show: 30% of the ticket price (applicable only until the time available for the reservation cancellation on web)
- However, if the paid amount is below 1,000 KRW, 1,000 KRW of the cancellation charge shall be imposed pursuant to the minimum payment amount policy of the card and payment agency.
11. Any matters on refund, return and exchange that have not been defined in these Terms and NHN Ticketlink website as well as application of cancellation fee for certain shows shall follow the provision defined in the Consumer Injury Compensation Rule.
Article 30 (Cancellation by Payment Methods)
1. Payment by Credit Card
(1) If the User requests for the cancellation of the reserved ticket(s), his/her reservation will be cancelled upon deducting the cancellation fee imposed depending on the time of the cancellation.
(2) The method and day of refund for the cancelled amount shall depend upon the time of cancellation and standard established for refund by each concerned card company and the refund policy of the card used shall follow the policy of the concerned credit card. If your reservation status indicates ‘cancellation upon deposit’ or ‘refund all’ upon cancellation, it shall mean that NHN Ticketlink has normally cancelled the reservation without fail.
2. Payment by account transfer
(1) Upon the reservation cancellation request of the User, the Company deposits applicable refund after deduction of the cancellation fees and remittance fees to the User’s refund bank accounts held by an account holder designated by a customer on the following day (business day) that comes after the cancellation request day.
3. Payment by deposit without bankbook
(1) In case the User requests for a cancellation of reservation, NHN Ticketlink shall deposit the amount that the User had entered and authorized to the User’s bank account after deducting the cancellation and remittance fee.
4. Payment with micropayment using mobile phone
(1) Pursuant to the policy of the mobile service carrier responsible for the mobile phone micropayment, the Company shall cancel the reservation should the User requests for a cancellation for a ticket that will be claimed for payment in this month; however if the user requests for a cancellation in the month that follows the payment month, the Company shall deposit the amount to the refund account entered and authorized by the User that is created under the name of the booker him/herself.
In this case, the cancellation fee will be deducted from the refund amount (the actual fee will depend upon the mobile phone payment fee and the time of cancellation).
Article 31 (Cancellation by Ticket Delivery Method)
1. Booker who chose mail delivery
(1) He/she may directly cancel via internet or call center on the day of reservation.
(2) If the reserved ticket has already been delivered, the User may submit for return request according to the refund policy set forth by NHN Ticketlink.
(3) Even though the ticket has been delivered, the User may cancel the reservation only if he/she had successfully returned the ticket to NHN Ticketlink by the closing of the show/event. The User may proceed with the return process, for the partial cancellation, only when returning the desired ticket for cancellation.
(4) The User must identify his/her contact information, reason for return and bank account information opened under the name of the concerned User, only if he/she had paid for the tickets via deposit without bankbook, where the User will receive the refunded amount when submitting for ticket return and enclose with the ticket to cancel.
(5) The ticket you have received is marketable securities just like cash or gift voucher. Please note that cancellation and change of reservation shall be unavailable if you have lost or damaged the ticket received.
2. Booker who chose receipt on the site
(1) The User may directly cancel the ticket via internet on the day of reservation.
(2) The ticket will be available for cancellation by the cancellation deadline of the reserved ticket, however the cancellation fee pursuant to Article 29 shall be imposed.
(3) There are some items that do not allow partial cancellation and cancellation fee shall be imposed for the cancelled ticket even for the partial cancellation.
Article 32 (Regulation on Fictitious Purchase)
1. NHN Ticketlink shall apply the restriction regulations on the following fictitious purchases:
(1) The Company deems it abusive use of the Services if, as for performance, the User who had cancelled more than fifty (50) tickets within one (1) month cancelled another reservation for the second time regardless of the number of tickets and attempts to reserve for the third time, and if the reservation of the User is cancelled from his/her failure to fulfill the wire deposit more than five (5) times for the same event and exhibition, thus may limit the User’s payment method to deposit online only.
(2) If the User is cancelled with his/her reservation for the sports event from failing to complete the deposit without bankbook more than thirty (30) times in the same season, the Company may limit the User’s payment method to deposit online only.
2. Notwithstanding the Section 6 Article 29, if a specific User for a specific show uses the reservation Services abusively on purpose or the Company deems it as such: for example, within the last three (3) months, such User (i) reserved no less than sixty (60) tickets and cancelled them all, or (ii) reserved and cancelled no less than twice, the Company may restrict such User’s reservation of the entrance ticket for the show concerned or every shows for no less than one (1) month to protect bona fide Users. However, such User shall be given an opportunity to be heard for no less than one day immediately thereafter and if such User submits a reasonable explanation with the said period, such restriction may be lifted.
3. If the User causes damages to the Company or other Users by repeatedly making reservations and cancellations for dishonest purposes, the Company may restrict, suspend or terminate the membership of such User pursuant to Article 9.
Chapter 8. Others
Article 33 (The Relationship between Connecting “Mall” and Connected “Mall”)
1. In the event that the upper “Mall” and the lower “Mall” are connected by hyperlink, etc. the former shall be referred to as the connecting “Mall” whereas the latter shall be referred to as the connected “Mall.”
2. Where the fact that the Company shall not be responsible for providing guarantees for transactions made with users by the goods or services independently provided by the connecting “Mall” and the connected “Mall,” is specified on the website of the of the connecting “Mall,” it shall not be responsible for providing guarantees for the transactions
Article 34 (Reversion of Copyrights, Use Restrictions)
1. The copyrights and other intellectual property rights to the works prepared by the Company shall revert to the Company.
2. Without the prior permission of the Company, users shall not duplicate, transmit, publish, distribute, broadcast, use by other means for profitable purposes, or cause a third party to use any information acquired in using NHN Ticketlink.
Article 35 (Dispute Resolution)
1. The Company shall establish and operate a damages compensation department to ensure that it reflects reasonable opinions or complaints raised by users and compensate for the damages.
2. The Company shall first handle complaints or opinions given by a user; provided, however, that where it is difficult to handle them promptly, the Company shall forthwith notify the user of the reasons and action schedules.
3. The disputes incurred between the Company and the Users are subject to settlements rendered by the Korea Fair Trade Commission established according to the Framework Act on Electronic.
Article 36 (Jurisdiction and Governing Laws)
1. Any lawsuit arising from dispute on electronic commerce between NHN Ticketlink and its Users shall be submitted to the competent court in the code of civil procedure.
2. Any lawsuit for electronic commercial transactions brought between the Company and users shall be governed by the Korean laws.
Article 37. (Disclaimer)
1. NHN Ticketlink is exempt from the responsibilities to provide Services if it is incapable of doing so due to natural disasters or other uncontrollable events.
2. The Company shall not be liable for any disruption or other interruption in the use of the Services that has arisen for a reason attributable to the User.
3. NHN Ticketlink shall not be responsible for the loss of the profit that the User expects from using the Service and the damage the User experiences from the material he/she had acquired through the Service.
4. NHN Ticketlink is not responsible for the contents, including the reliability, accuracy and etc., of the information, material and fact the Member has uploaded.
5. The Member shall be liable for the contents of the mail he/she has sent and the Company shall in no event be liable for such contents. information to another.
Article 38 (Jurisdiction)
Any lawsuit shall, if brought in connection with a dispute arising out of this Service, be submitted to the competent court having jurisdiction over the place where the head office of NHN Ticketlink is located.

1. These Terms and Conditions shall become effective as of September 1, 2011.
2. Previous Terms and Conditions shall be replaced with these Terms and Conditions as of July 1, 2010.
3. Previous Terms and Conditions shall be replaced with these Terms and Conditions as of February 23, 2013.

1. Collected Personal Information
NHN Ticketlink collects the following personal information to provide various services to its users.
As the Company provides the service using PAYCO membership system, it receives the following personal information from PAYCO.
• - ID, payment record
The following information may be automatically created and collected during service use.
• - IP Addresses, cookies, dates and times of logins, logs of service usage, logs of usage errors, device information when using mobile services (device model, mobile carrier information, hardware ID, Advertising ID, basic statistics about service usage), information on applications installed in the User's device (including time of installation and run time), payment records, and User’s location information provided that the User has consented to the Terms of the Location Based Service
2. Personal Information Collection and Purpose for Use
NHN Ticketlink uses the collected personal information for the following purposes:
• - Service Implementation
Implementing the agreement on service provision, settling the payment for service, providing contents, purchase and payment, delivery of products and billing address, verification of identity during financial transaction, financial service and collection of payment
• - Management of Users
Personal identification for service use, identification, restricting abusive/unauthorized use of delinquent users, confirm intention of use, restricting number of uses, handling customer services, including complaints, delivering notifications and confirming the intention to unsubscribe.
• - Marketing and Product Advertisement
When developing/specializing new services (products), providing notices on and recommending financial products and amenities, sending for-profit advertisement information (via phone call, post, email, SMS, etc.) such as events, offering services based on statistical characteristics and placing advertisements, identifying access frequency, collecting statistics on member’s service usage.
3. Retention and Use Period of the Collected Personal Information
In principle, a User's personal information shall be stored until the User withdraws its registration. However, the Company may store personal information for 3 days after a User requests to cancel his or her membership, in order to be prepared for cases in which the cancellation was involuntary due to identity theft. Also, the following items shall be preserved for the specified durations for the following purposes
• Stored Information: Records on delinquent use
• Reason for Retention: To prevent abusive use
• Duration of Retention: One (1) year
In case the information needs to be stored according to regulations in related laws, NHN Ticket link stores its members’ information for the period of time as defined in the related legislation.

Introduction
The Organizing Committee of the 18th FINA World Championships Gwangju 2019(hereafter Gwangju 2019) has established the following Terms and Conditions for the purchase, possession and use of Tickets to the 18th FINA World Championships Gwangju 2019. Please read these Terms and Conditions carefully. Any person who purchases by ordering, purchasing, holding or using a Ticket you are certifying that you have read, understood and accepted these Terms and Conditions.

1. Definitions & Interpretations
1.1 “Gwangju 2019” refers to the Organizing Committee of the 18th FINA World Championships Gwangju 2019. Gwangju 2019 is a legal entity established in the Republic of Korea to plan, promote and hold the 18th FINA World Championships Gwangju 2019.
1.2 “Gwangju 2019 Official Website,” www.gwangju2019.com, is the official internet site for the 18th FINA World Championships Gwangju 2019.
1.3 “Gwangju 2019 Ticketing Website,” https://tickets.gwangju2019.com, is the official internet site providing spectators with the ability to obtain information about the Ticketing program and providing eligible Persons with the opportunity to purchase tickets.
1.4 “Championships” refers to the 18th FINA World Championships Gwangju 2019.
1.5 “Championships Body” refers the Gwangju 2019. FINA, FINA Sponsors, Agency, KSF, Ministry of Culture, Sports and Tourism, Gwangju Metropolitan City, Yeosu City, Swimming NF of each country, or any other organizing committee for the Championships.
1.6 “Session” refers to an event or group of events at the Championships (including, without limitation, sport events, opening and closing ceremonies) for which tickets have been issued by Gwangju 2019.
1.7 “Venue” means any location under the control of Gwangju 2019, access to which requires a Ticket, and any adjacent areas that are under the control of Gwangju 2019.
1.8 “Personal Data” is information that identifies an individual and may include (but not necessarily limited to) individual’s name, address, telephone number, email address, date of birth, government identification numbers(resident registration number, passport number) and ticket purchase details.
1.9 “Person” refers to an individual, partnership, firm, corporation, association, trust, unincorporated association or any other legal person.
1.10 “Photographic Identification” refers to a valid photo identification document issued by an official government authority, providing the holder’s identity (original passport for non-residents of Korea, or other document in accordance with the legislation of the Republic of Korea for Korean residents).
1.11 “Terms and Conditions” refers to the terms and conditions set here.
1.12 “Stakeholder” means FINA, FINA sponsors, Gwangju 2019 sponsors, rights holding broadcasters, Republic of Korea government, Host City government and government-affiliated organizations.
1.13 “Ticket” is evidence of license issued by Gwangju 2019 which entitles the holder to admission to a Session, which may be a conventional printed ticket of admission, in mobile form or a print-at-home generated form.
1.14 “Ticket Purchaser” refers to the Person who has ordered and paid Gwangju 2019 or an ATR for one or more Tickets and will be registered in Gwangju 2019 and/or ATR’s records as the original purchaser of Tickets.
1.15 “Ticket Holder” refers to the Person who is in possession of a valid Ticket and for the avoidance of doubt, includes a Purchaser and/or any other Person who purchases, holds or uses a Ticket, regardless of nationality, and without any limitation as to the source used to acquire the Ticket.
1.16 “Authorized Ticket Sources” refers to all official sources authorized by Gwangju 2019 to sell or otherwise distribute Tickets, including the Online Authorized Ticket Sources, the On-site Authorized Ticket Sources, ATR websites or offices, or any other organization or entity expressly authorized by Gwangju 2019 to sell or otherwise distribute Tickets for the Championships. The complete list of Gwangju 2019 Authorized Ticket Sources can be found at https://tickets.gwangju2019.com
1.17 “Online Authorized Ticket Sources” refers to the official sources authorized by Gwangju 2019 to sell or otherwise distribute Tickets online, to be specific, (i) the Gwangju 2019 Ticketing Webite and (ii) Fan-to-Fan.
1.18 “On-site Authorized Ticket Sources” refers to the official sources authorized by Gwangju 2019 to sell or otherwise distribute Tickets offline, to be specific (i) the Main Ticket Center located in Gwangju Metropolitan City, (ii)the Ticket box offices established near the sports Venues, (iii) Ticket selling outlets established by Gwangju 2019 in the Republic of Korea.
1.19 “ATR” refers to “Authorized Ticket Reseller,” an entity appointed by Gwanju 2019 to act as an agent to promote, sell and distribute Tickets within the designated area.
1.20 “Fan-to-Fan” refers to the official Gwangju 2019 ticket resell program, a service provided by Gwangju 2019 at its official web portal, for the purpose of allowing ticket reselling transaction by Ticket Purchasers.
1.21 “Order” refers to an application or request to purchase Tickets made by a purchaser, encompassing those requests being processed and the ones already processed, regardless of whether the Purchaser has been successful or unsuccessful in purchasing the intended Tickets.
1.22 “Proof of Discount Eligibility” refers to a valid photo identity document issued by the Republic of Korea government, which proves provides discount eligibility.
1.23 “FINA” refers to the international federation that governs international competition in water sports.
1.24 “OC” refers the Organization Committee of the 18th FINA World Championships Gwangju 2019
1.25 “HMF” refers to the Korea Swimming Federation(Host Member Federation)
1.26 “NF” refers to the National Federation
1.27 “Commercial Affiliate” (CA) refers to any entity which has been granted commercial rights and opportunities in respect of the Championships, including FINA Partners and OC Sponsors.
2. Applicable Terms and Conditions
2.1 All tickets are sold and issued are subject to these Terms and Conditions
2.2 By ordering, purchasing, holding, or using a Ticket, Ticket Purchasers or Ticket Holders agree to comply with these Terms and Conditions.
2.3 Ticket Purchasers and Tickets Holders are responsible for complying with these Terms and Conditions. Gwangju 2019 reserves the right to terminate the license granted by a Ticket purchased or obtained from or through other sources than the Authorized Ticket Sources.
2.4 A Ticket Purchaser must be at least fourteen (14) years of age at the time of purchase. A Ticket Purchaser eighteen (18) years of age must get an approval from his/her legal guardian when making an order and purchase. In the event that any other age restriction is defined by Korean laws, these Terms and Conditions will be amended pursuant to the procedure stipulated in clause 2.5.
2.5 In case of amendments to the Terms and Conditions, the changes need to be announced through the Gwangju 2019 Ticketing Website at least seven (7) days before the revision. Moreover, when the changes adversely affect consumers, Gwangju 2019 has to notify of such changes at least 30 days before the revision.
2.6 When purchasing tickets, the Ticket Purchaser agrees that they will make any associated Ticket Holders will be made fully aware of all the relevant rules and regulations regarding the Ticket Holder’s use of a Ticket to attend a Session at a competition or ceremony Venue. Specifically, the Ticket Purchaser agrees to bring attention of the Spectator Policy attached to the ticket to the Ticket Holders.
2.7 The prices of Tickets shall be fixed by Gwangju 2019. The criteria for purchase, cancellation, transfer, refund or seat allocation shall be defined by Gwangju 2019.
3. Tickets Purchased from Gwangju 2019 (within the Republic of Korea)
3.1 Residents of the Republic of Korea may only purchase Tickets directly from Authorized Ticket Sources of Gwangju 2019 or from authorized reseller(s) appointed by Gwangju 2019 to sell ticket packages within the Republic of Korea, should any authorized provider(s) be appointed.
3.2 Residents of all countries other than the Republic of Korea may only purchase Tickets from the ATR(s). List of ATRs is available at the Gwangju 2019 Ticketing Website. Residents of countries other than the Republic of Korea should comply with the policy of their relevant ATR. In this case, Ticket Purchasers and Resellers should follow the purchase procedures outlined in clause 3.1.
3.3 Gwangju 2019 Stakeholders and members of the Championships Body, may have a contractual rights to request and purchase tickets, as per the terms of their individual contract or charter.
3.4 A Purchase contract is concluded when a transaction confirmation from Gwangju 2019 has reached the Ticket Purchaser after payment. To be specific, Gwangju 2019 shall not distribute Tickets until the transaction confirmation has been sent to the Ticket Purchasers after payment. No communication from any third party other than Gwangju 2019 shall be deemed as official confirmation of the transaction, including text messages or any other information from the Ticket Purchaser’s bank or credit card company. Ticket Purchasers can immediately request an Order modification or cancellation when incorrect information has been found on the transaction confirmation. In this case, Gwangju 2019 will process the requests without delay.
3.5 Gwangju 2019 may at its sole discretion, refuse or cancel Ticket Orders: (i) made in breach of these Terms and Conditions and other purchase rules ad applicable law or (ii) made from anyone whom they believe plans to distribute or offer a Ticket for resale other than in accordance with these Terms and Conditions or (iii) made from anyone who they believe to have provided misleading or fraudulent information in the course of purchasing Tickets or (v) made from anyone who is under the age of fourteen. Even if in possession of approved Ticket Orders, the Tickets are invalid. Gwangju 2019 is under no obligation to unconditionally approve any Ticket Orders.
3.6 Gwangju 2019 may not be held liable if a Ticket Purchaser cannot receive tickets or the purchased Tickets become invalid due to the incorrect or fraudulent information entered by the Ticket Purchaser when submitting an Order or completing a purchase Ticket Purchasers are responsible for verifying the accuracy of their Ticket Order at the time the Order is submitted or the purchase is made. Mistakes cannot necessarily be rectified after the purchase is completed. If the Ticket Purchaser believes there has been a mistake, they must contact the Main Ticket Centers or the relevant customer service centers immediately.
3.7 Sales of Tickets by Gwangju 2019 will occur in various phases. Each sales phase will hve specific rules, which may also be specific to the category of Ticket Purchaser. When making an Order, the Ticket Purchaser agrees to abide by all the specific purchase. These purchase rules will be clearly outlined as part of the purchase process and will be described in details at the Gwangju 2019 Ticketing Website. Any attempt to circumvent or avoid adherence to the purchase rules may result in the order being rejected.
3.8 A Ticket Purchaser may also be restricted in applying for maximum number of tickets to Sessions. The maximum number of Sessions and Tickets to Sessions will be set out at the Gwangju 2019 Ticketing website.
3.9 Unless otherwise stipulated in these Terms and Conditions, once an Order has been submitted, it will not be possible for a Person to alter, amend, withdraw or cancel an Order subject to the rules of the particular sales phase, as described in clause 3.7.
3.10 Submitting an Order for Tickets does not guarantee the availability of the requested Tickets. The ability of Gwangju 2019 to satisfy Ticket Orders depends on the total demand and available inventory, and is subjected to the rules and requirements of the specific Ticket sales phase, as outlined in 3.7.
3.11 Starting from January 2019, Tickets may be purchased through On-site Authorized Ticket Sources. Tickets will be available offline starting on April 2019 at the official on-site Main Ticketing Center and at the entrance of each Venue starting July 12, 2019. On-site Authorized Ticket Source Order transaction will be complete once the Ticket Purchaser selects Session and number of Tickets.
3.12 The cancellation of on-line purchase by the Ticket Purchaser of an Order is possible within seven (7) days of the Ticket Purchaser receiving confirmation of transaction, pursuant of the Consumer Protection Act of Electronic Commerce. However, cancellation will not be accepted of an Order on and after July 1, 2019. Please note that the Ticket Purchaser shall be liable for the delivery fee incurred due to the cancellation. Additional refund policies respect thereto includes the following: returning actual Tickets to Gwangju 2019, cancellation/postponement due to natural disasters (torrential rain, hurricane, etc.), death, communicable disease and hospitalization of Purchaser of Ticket (attach medical /death certificate with refund application). If a Session is postponed and rescheduled, the Purchaser may view the rescheduled Session with the original Ticket.
3.13 Should a Person, regardless of country of residence, believe that Tickets for purchase are being offered that violates these Terms and Conditions, Person should immediately contact the Main Ticket Center or Customer Service Call Center.
4. Tickets Purchased from Authorized Ticket Reseller(outside the Republic of Korea)
4.1 As stated in clause 3.2 of the Terms and Conditions whereas Gwangju 2019 approved agency may promote ticket sales in a specific are or territory. Travel Agency approved as the designated dealer shall determine rules and procedures governing sales of tickets in designated area or territory. Travel agency has the authority to place limits on how many Tickets or Sessions a Ticket Purchaser may Order, determine the purchase, determine the limit Tickets, the number of Session Tickets to be Purchased, and determine the purchase, distribution and payment methods. In case of a discrepancy between the purchase terms and conditions placed by the Travel Agency and the Terms and Conditions set here, the latter shall prevail.
4.2 The Travel Agency, at its sole discretion, may refuse to sell Tickets to any person who attempts to circumvent or does not intend to adhere to any purchase rules or restrictions set forth. The Travel Agency is obligated to refuse the sale of Tickets to any person whom it believes plans to distribute or offer Ticket for resale other than in accordance with these Terms and Conditions.
4.3 Tickets issued by Gwangju 2019 with face value price denominated in Korean Won(KRW). Appointed Travel Agency will always conduct ticket sales in currency of designated territory, and will convert Ticket price from KRW to local currency using rates published by major banking institutions as approved by Gwangju 2019. Any or all bank/other charges incurred as a result of payment with credit card or currency conversion will be the sole responsibility of Ticket Purchaser.
4.4 The Travel Agency may charge a reasonable per-ticket handling charge over and above the value price of the Ticket. This fee may not be more than 20% of the face value price of the Ticket.
4.5 Should a Person, regardless of residence, believe tickets being offered on terms that violate the Terms and Conditions set here, Person should immediately contract relevant Travel Agency or Gwangju 2019.
5. Ticket Pricing
5.1 The face value price of each Ticket shall be established by Gwangju 2019. All Ticket prices are denominated in Korean Won (KRW), and include any applicable tax, but excludes fees for booking, collection and delivery fees.
5.2 Gwangju 2019 may set special Ticket prices for Koreans with disabilities(class1-6), citizens 65 years and over, children and youth 18 years, persons honored with merit and distinguished service(including those who fought for May 18th Democratic Uprising). The specific criteria and discount rates can be found on the Gwangju 2019 Ticketing Website. Ticket Holders taking advantage of such discounted Ticket prices may be required, upon request by any official, employee, volunteer, or authorized partner or contractor of Gwangju 2019 or the Venue to provide Proof of Discount Eligibility. Failure to present Proof of Discount Eligibility represents a material breach of these Terms and Conditions. It may result in the cancellation of the Order or of the Tickets issued. In addition, the Ticket Holder may be refused admittance to the Venue, be asked to leave the Venue, or be required to pay the full adult price of the Ticket.
6. Payment
6.1 The act of Gwangju 2019 confirming an Order for Tickets, the Ticket Purchaser is authorizing Gwangju 2019 to collect payment for any Tickets which may be allocated to the Ticket Purchaser, inclusive of any applicable processing or delivery fees.
6.2 Payment methods for purchasing Tickets can be made by credit card, debit card, check card and cash (including bank transfer).
6.3 Full and timely payment for all Tickets and delivery fee (if applicable) are of essence and material obligation of Ticket Purchaser. The Ticket Purchaser has to make payment after submitting an Order using cards (credit, debit, check), cash or bank transfer. The Ticket Purchaser is solely responsible for ensuring that payment method is valid and that all required information is provided and confirmed, and Purchaser must have sufficient funds for duration of applicable sales phase until payment is collected by Gwangju 2019. If payment cannot be collected by due date, Gwangju 2019 reserves the right to refuse the associated Ticket Order.
6.4 Only cards (credit, debit, check) and bank transfer are acceptable for purchase at Online Authorized ticket Sources. For purchase at On-site Authorized Ticket Sources, cards (credit, debit, check) and cash are acceptable. Payment must be made in Korean Won in all circumstances.
6.5 For Tickets purchased prior to the Championships, Stakeholders, partners and members of the Championships Body, will make payment using payment method specified by their individual contractual agreement
7. Delivery
7.1 For Ticket Purchasers from the Republic of Korea who choose the home delivery option, Tickets will be delivered to the delivery address provided by the Ticket Purchaser at the time of ordering Ticket. In cases where Ticket Purchaser choose to receive Tickets by mobile or at print-at-home format, the Tickets will be delivered through and/or pursuant to Gwangju 2019 Ticketing Website and will be activated before the Games.
7.2 Recipient signature may be required upon delivery of Tickets. Post Office Boxes (or similar) are not acceptable addresses for Ticket delivery.
7.3 For discounted Tickets, the Ticket Purchaser may collect the Tickets at the Main Ticket Center or Ticket Box Office. The Tickets may be delivered in person, delivered via mobile format or a print-at-home format depending on Ticket Purchaser preference.
7.4 Once in the possession of Ticket Purchaser, the Ticket Purchaser is solely responsible for safeguarding all Tickets. The Ticket Purchaser shall not be entitled to any compensation for lost, stolen, forgotten or damaged Tickets.
7.5 If Tickets to the relevant Session have not been received seven (7) days before the commencement of the said Session, it is the sole responsibility of the Ticket Purchaser to contact Gwangju 2019 (contract information can be obtained from the Gwangju 2019 Ticketing Website). Gwangju 2019 is not responsible for the Tickets not received due to Ticket Purchaser’s failure to contact Gwangju 2019.
7.6 If Gwangju 2019 fails to deliver Tickets without reason (i.e, incorrect address), Gwangju 2019 shall notify the Ticket Purchaser that the purchased Ticket may be collected at a designated place within a specified period by Gwangju 2019.
7.7 Gwangju 2019 is not responsible for the delivery of the Tickets purchased or obtained through any sources other than Gwangju 2019, including from Authorized Ticket Sources.
7.8 The ATRs, authorized by Gwangju 2019, assumes full responsibility for the delivery of Tickets purchased or obtained through them.
8. Tickets
8.1 All Tickets remain the exclusive property of Gwangju 2019.
8.2 A Ticket is granted a revocable license to enter a Venue to attend a Session. A valid Ticket must be produced to gain admission to a Session or a Venue. Gwangju 2019 may revoke this license at any time if such Ticket Holders are not in compliance with these Terms and Conditions.
8.3 Ticket Holders may enter a Venue to attend Sessions and occupy space or seat at a Session. This may be specific, reserved seat or space or may be for general admission to designated spectator area in the Venue.
8.4 For Ticket Purchasers who purchased discounted Tickets, the presentation of proper Photographic Identification and a Proof of Discount Eligibility is mandatory when entering the Venue. Failure to produce proof of eligibility may result in Ticket Holder being required to pay the remaining portion of the full adult price of Ticket. Refusal to pay remainder may result in the refusal of admittance to the Venue of the Ticket Holder, who may also be asked to leave the Venue. In such cases, the Ticket Purchaser will not be eligible for a refund.
8.5 Ticket Holders have responsibility for all Tickets in their possession and are solely responsible for safeguarding all Tickets. Neither the Ticket Holder nor the Ticket Purchaser shall be entitled to any compensation for lost, stolen, forgotten or damaged Tickets. It may not be possible to issue duplicate Tickets. A Ticket Holder may be denied entry or asked to leave the Venue for removing any part of, altering, or defacing a Ticket.
8.6 In principle, if a Ticket Holder leaves a Venue for any reason other than an emergency evacuation, the Ticket Holder may not use the same Ticket to re-enter the Venue and the Ticket Holder agrees that Gwangju 2019 may void Ticket and resell unoccupied seat or space at the Session to another Ticket Purchaser.
In rare cases, re-entry may be permitted and a Ticket Holder who leaves a Venue may use the same Ticket to re-enter the Venue. The Ticket Holder may be requested to scan Ticket when leaving the Venue, and the same entry procedures will apply when re-entering. Information on possible re-entry will be detailed at the Gwangju 2019 Ticketing Website.
8.7 Ticket Holders must retain their Tickets at all times while attending the Session and the Ticket must be produced for inspection upon request by any authorized person, including any official, steward, police officer, volunteer or employee of Venue or Gwangju 2019. Failure to do so may result in the Ticket Holder being required to leave Venue.
8.8 A Ticket Holder may be required to show his or her Ticket upon exiting the Venue perimeter.
8.9 In cases where the Ticket Purchaser chooses the print-at-home format, the Ticket Purchaser agrees not to distribute or allow distribution of duplicate copies of such Tickets and any such duplicate copies will not be valid for entry to Venue. The Ticket Purchaser further acknowledges that any such attempt to distribute duplicate copies of pint-at-home Tickets shall be considered fundamental breach of these Terms and Conditions and may result in all purchased Tickets being considered void and not valid for entry to Venue. In such cases, the Ticket Purchaser shall not be entitled to any reimbursement for the cancelled Tickets.
8.10 Gwangju 2019 reserves the right to reassign a Ticket Holder to an alternative seat or space (as determined by Gwangju 2019 at its sole discretion) for any Venue or Session. Tickets can be reallocated in a lower price category, in which case necessary reimbursement will be conducted. Please note, multiple Tickets sitting ‘together’ might be changed to Tickets sitting ‘not together’ with no reimbursement. If a ticketed seat or space cannot be provided, the Ticket Purchaser may apply for a refund as outlined in these Terms and Conditions.
8.11 On the day of the Session, Ticket Holders will be entitled to use the shuttle bus services provided by Gwangju 2019 to transfer to and from the Venues. The shuttle service shall be provided free of charge.
8.12 Ticket Holders should allow sufficient time before the Session to travel to and access the Venue, considering travel time and time required for queuing and security screening prior to entering the Venue. A Ticket Holder arriving after the commencement of a Session may be required to wait for an appropriate break in the competition before being granted access to seat and in which case Ticket Holder must follow the instructions of the stadium ushers. No refunds shall be granted for late arrival to Venue to the Ticket Holder or the Ticket Purchaser.
9. Resale and Transfer of Tickets
9.1 Tickets may not be purchased or obtained from or through any sources other than from Authorized Ticket Sources. Gwangju 2019 is not responsible for Tickets from any sources other than from Authorized Ticket Sources. Tickets from other sources may not be re-issued and may be declared void and be sized or cancelled. Entry may also be denied when Ticket scanning system cannot scan the Ticket if the Ticket was acquired from other sources. In these cases, the Ticket Purchaser is not eligible for a refund.
9.2 Except as specified in clauses 9.3, 9.5 and 9.6, ticket must not be sold nor advertised for sale whether on the internet, newspapers or elsewhere.
9.3 Ticket Purchasers can resell their Tickets at face value only at sites authorized and designated by Gwangju 2019.
9.4 Stakeholders and the partners and members of the Championships Body may distribute the Tickets at no cost to its employees, officially invited guests or other persons in a manner authorized by Gwangju 2019.
9.5 Tickets may not be transferred to any Person who pays or agrees to pay for some other goods or services, such as a hospitality package or accommodation, unless authorized by Gwangju 2019. A Ticket may not be offered as part of package of goods and services, including hospitality packages) contrary to this clause 9.5 shall be void, and may be seized or cancelled without refund or entry to a session.
9.6 Tickets may not be used for advertising, promotion, auctions, fundraising or marketing purposes (including in competitions, contests and sweepstakes) without prior written consent from Gwangju 2019. Tickets used for advertising, promotion, auctions, fundraising or marketing purposes without the authorization of Gwangju 2019 (including competitions, contests and sweepstakes) shall be void, and may be seized or cancelled without refund or entry to a Session.
10. Void Tickets
10.1 Any Ticket reasonably believed to have been obtained in breach of these Terms and Conditions shall be void and all rights conferred or evidenced by such Ticket shall be null and void. In such a case, the Ticket Purchaser will not be eligible for a refund.
10.2 Any Person seeking to use a Ticket reasonably believed to have been obtained in breach of these Terms and Conditions in order to gain entry to or remain at a Session may be considered to be a trespasser and may be liable to be ejected and liable to legal action.
11. Counterfeit, Altered & Scalped Tickets
11.1 Gwangju 2019 applies codes such as special characters, special characters, passwords, etc., to prevent any tampering of admission Ticket.
11.2 Tickets for ceremonies and Sessions viewing authorized by Gwangju 2019 are classified as marketable securities, and anyone who forges or alter tickets without the approval of Gwangju 2019 may be punished under the Korean Penal Code.
11.3 Any person that sells Ticket to another individual at a premium price that is higher than the Ticket price approved by Gwangju 2019, may be punished for violating the Punishment of Minor Offenses Act.
11.4 Gwangju OC may be asked to cooperate with law enforcement agencies in order to prevent forgery, alteration and scalping of Tickets
12. Schedule Changes, Delays, Postponements & Cancellations
12.1 Ticket Holders acknowledge that Sessions may be delayed, or postponed. Gwangju 2019 will use reasonable efforts to communicate such delays or postponements to Ticket Purchasers. It is the Ticket Purchaser’s responsibility to communicate such information to the Ticket Holder. As soon as Gwangju 2019 becomes aware of a Session being delayed, interrupted, rescheduled or postponed, Gwangju 2019 will promptly post relevant information on the Gwangju 2019 Official Website. The official competition schedule is posted only on the Gwangju 2019 Official Website. No other websites contain the official competition schedule including dates, times, and country/team draws. Gwangju 2019 is not responsible for any other website data or country/team listings. It is the responsibility of a Ticket Holder to check whether any change has been made to the Session schedule. Gwangju 2019 does not guarantee that Ticket Holders will be informed of such delay, or postponement before the date of the Session concerned.
12.2 If a scheduled Session time is delayed but the Session is completed on the same calendar day, Ticket Holder with Tickets for the delayed Session shall not be eligible for a refund. There will be no exchanges of Tickets for another Session.
12.3 If a Session commences as schedules and is interrupted after it begins, and Gwangju 2019 determines that it was substantially completed, neither the Ticket Purchaser nor the Ticket Holder of the interrupted Session shall be eligible for a refund. Please note, it is not possible to exchange the Tickets for another Session
12.4 If a Session commences as scheduled but is interrupted and Gwangju 2019 determines that the Session was not substantially completed, and the Session is rescheduled to take place as a new Session (i.e. separate from an existing, scheduled Session), the Ticket Holder may retain original Ticket for admission to the rescheduled Session. Neither the Ticket Purchaser nor the Ticket Holder for the rescheduled Session shall be eligible for a refund. Please note, it is not possible to exchange the Ticket for another Session.
12.5 If a Session commences as scheduled but is interrupted and Gwangju 2019 determines that the Session was not substantially completed; and the Session is rescheduled as part of an existing Session (i.e. does not take place as a new Session), the Purchaser may apply for a refund as outlined in these Terms and Conditions. However, it is not possible to exchange the Tickets for another Session.
12.6 If a Session is cancelled (and not rescheduled), Gwangju 2019 will use reasonable efforts to communicate such cancellation in advance to Ticket Purchasers. It is the Ticket Purchaser’s responsibility to communicate such information to the Ticket Holder. Once Gwangju 2019 is notified of Session being cancelled, Gwangju 2019 will promptly post relevant information on the Gwangju 2019 Official Website. It is the responsibility of the Ticket Holder to ascertain the cancellation of a Session. Gwangju 2019 does not guarantee that Ticket Holders will be informed of such cancellation before the date of the Session concerned.
12.7 If a Session is cancelled (without notification), the Ticket Purchaser may apply for a refund as outlined in these Terms and Conditions.
12.8 Should Ticket Purchaser be entitled to a refund due to cancellation or postponement, under the conditions defined in these Terms and Conditions, they may apply for a refund according to provisions of clause 14 of these Terms and Conditions.
12.9 Except in rare cases specified in these Terms and Conditions, Gwangju 2019 is not responsible for the losses incurred by the Ticket Purchaser due to a Session being interrupted, rescheduled or cancelled.
13. Refund Procedures
13.1 Ticket Purchaser may request a refund if Session was cancelled due to natural disaster, weather deterioration and by submitting a medical certificate if Ticket Purchaser was not able to view Session due to accident, sickness, infectious disease or death. There will be no on-site refunds as all refunds will be batched processed at the end of the Championships.
13.2 There will be no on-site refunds, including at the Ticket Box Offices or the Main Ticket Centers.
13.3 All refund requests will be processed by Gwangju 2019 or the ATR depending on from whom the original Ticket were purchased. If entitled to a refund from an ATR, the Ticket Purchaser must contact the ATR from whom the original Tickets were purchased and follow their refund procedures.
13.4 If entitled to a refund for a Ticket directly bought through Gwangju 2019, Ticket Purchasers are solely responsible for recovering the Tickets from Ticket Holders and completing all the procedures described at the Gwangju 2019 Ticketing Website, including returning the original Tickets to Gwangju 2019. Gwangju 2019 shall endeavor to process all refunds in a prompt manner but the Ticket Purchaser must be aware that the completion of the refund process depends on the payment method chosen.
13.5 Refund should be made to the Ticket Purchaser, not to the Ticket Holder. A Person who wishes to be refunded must prove that he/she is the Ticket Purchaser by submitting to Gwangju 2019 the original Tickets and information of the credit card used for the payment or purchase receipts and any other necessary documents of proof.
13.6 Refunds will be made for the face value of the Ticket and there will be no refund of any applicable delivery fee or other incurred fees. Cancelled Tickets cannot be exchanged for the Tickets of other Sessions.
14. Personal Data
14.1 The Personal Data that Ticket Purchasers provide to Gwangju 2019 will be subject to applicable laws, used, processed and stored by Gwangju 2019 (may include spectator CRM information to FINA) in accordance with the terms of Gwangju 2019 Ticketing Privacy Policy (full details of which are available at the Gwangju 2019 Ticketing Website).
15. Liability
15.1 All Ticket Holders should strictly abide by the Spectator Policy attached to these Terms and Conditions. Ticket Holders are solely responsible for own safety, for the safety and movement of any accompanying children and for the safety of Ticket Holder(and companion) personal property.
15.2 Personal arrangements including travel, accommodation or hospitality relating to attendance at the Session which have been arranged by a Ticket Purchaser or Ticket Holder are at the Ticket Purchaser’s or Ticket Holder’s own risk.
15.3 Neither Gwangju 2019, any Venue owner, any member of the Championships Body nor other Persons involved in the organization of the Championships accept any responsibility for any loss, theft or damages of a Ticket Holder’s personal property. Ticket Holder will release Gwangju 2019, Venue owners, any member of the Championships Body and other Persons involved in the organization of the Championships from any liability for the loss or damage to personal property they may suffer in relation to his or her attendance at the Venue.
15.4 Neither Gwangju 2019, any Venue owner, any member of the Championships Body nor any other Persons involved in the organization of the Championships shall be liable for any failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure or by the acts of third parties.
15.5 Except as required by law, neither Gwangju 2019, any member of the Championships Body nor any other Persons involved in the organization of the Championships shall have any further liability to a Ticket Holder beyond the face value of the Ticket purchased (plus the relevant Ticket delivery fee if the Tickets have not yet been dispatched). Neither Gwangju 2019, any Venue owner nor any Championships Body shall be responsible to the Ticket Purchaser, or Ticket Holder for any indict losses or damages including, but not limited to, punitive damages, loss of enjoyment, goodwill or profit and/or travel accommodation expenses.
16. General
16.1 Any information requested relating to Tickets should be addressed to the relevant customer service center, the contact details of which can be found at the Gwagnju 2019 Official Website (www.gwangju2019.com) or from the Authorized Ticket Source from whom the Tickets were obtained.
16.2 If Gwangju 2019 delays or fails to enforce any of these Terms and Conditions, or other Authorized Ticket Sources fail to enforce any of these Terms and Conditions on behalf of Gwangju 2019, it shall not mean that Gwangju 2019 has waived its rights to do so at any subsequent time.
16.3 These Terms and Conditions constitute contractual purchase agreements between the Ticket Purchaser and Gwanjgu 2019. No party shall have any claim or rectify any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to the above cited agreements, which is not already set out in these agreements.
16.4 These Terms and Conditions have been drafted in Korean and translated to English. Translations of these Terms and Conditions to other languages may be made by Authorized Ticket Sources. In the event of any discrepancy between the Korean and a translated version of these Terms and Conditions, the Korean version shall prevail.
16.5 These Terms and Conditions are governed by the Law of the Republic of Korea. The Gwanjgu District Court shall be the Court of the First Instance for any disputes arising out of any transactions with Gwangju 2019.


Spectator Policy

1. Personal Property
1.1 Subject to the restrictions stipulated in the prohibited and restricted times below, baby strollers may be restricted from being taken into the competition Venue, and should be requested to be stored in a stroller storage room provided by Gwangju 2019. Spectators needing wheelchairs can attend competition with wheelchairs.
1.2 Gwangju 2019 has the exclusive right to determine what objects may be brought into a Venue by Ticket Holder. Gwangju 2018 will not store confiscated and/or unauthorized items at a Venue and Ticket Holder will have no right for the item to be returned.
2. Prohibited and Restricted Items
2.1 Prohibited Items
All spectators, including Ticket Holders, are prohibited from transporting into a Venue any of the following items. Any spectator or Ticket Holder found to be in possession of any of the below items will have the items seized (with no right to have the items returned), shall be removed from Venue, and may be subject to arrest and/or prosecution by the relevant authorities. The list below represents a summary of prohibited items and is subject to change at the discretion of Gwangju 2019. An updated, detailed list of prohibited items can be found at the Gwangju 2019 Ticketing Website.
2.1.1 Explosive Materials & Ignition Devices (or parts thereof)
- All explosive materials: TNT, dynamite, plastic explosives, liquid explosives, powdered explosives, including ammoniac explosives, etc.
- Electric detonators, blasting caps
- All forms of fireworks
- Incendiary devices: Flares and ignition devices (including flare guns), detonators and connecting devices
- Electro-mechanical devices which may remotely activate explosions
- All materials that can be used as improvised explosives
2.1.2 Firearms (or parts thereof) and All Devices and Ammunition suspected of Weapons
- All firearms (including those which can discharge projectiles from inside the firearms using gas or air pressure)
- Parts of any kind of firearm
- All types of ammunition and gunpowder
- Realistic replicas of firearms (fake firearms, toy guns, copies and imitations of firearms)
- Other items that are not shaped like normal guns but may be used in a similar way
2.1.3 Narcotics and Psychotropic Drugs, Cannabis
- Narcotic and psychotropic drugs and cannabis which are prohibit5ed to be produced, stored, possessed, and used according to the applicable laws of the Republic of Korea
◇ Exceptions
- Medications that contain narcotics and psychotropic drugs that have been prescribed by a doctor with the presentation of such documentation (signed or sealed with the name and address of the hospital of the doctor’s license number)
2.1.4 Weapons of Any Other Materials that Pose a Threat
- All forms of knives, (short) swords, pocketknives, scissors, and razors
- Harpoons, crossbows, arrows
- Ice picks, saws, axes, screwdrivers, hammers, pliers, wrenches
- Drills, nail guns, electric saws, cutters
- Needles, pins
- Camera stands, poles, trekking poles, golf clubs, bats, helmets
- Other large materials that may cause physical harm
◇ Exceptions
- Selfie sticks (except those of excessive length or thickness that may threaten others’ safety)
- Essential items (including stick, trekking pole, etc.) in the aid of people with limited mobility
- Required items for movement, eating and drinking (including special knives, openers, etc.) for patients, infants, and people with proven medical conditions
2.1.5 Compressed and Liquid Gas
- Household gas (butane and propane gas in a container)
- Other sprays which use compressed and liquid gas as a solvent
- Compressed and liquid gas that may temporarily or permanently harm people
- Fillers and connecting devices for any compressed or liquid gas
- Other devices or substances suspected of containing compressed or liquid gas
◇ Exceptions
- Lighters or matches for smoking (except items that look like firearms or are dangerous)
2.1.6 Strong Acids and dangerous Items (flammable)
- Potent acidic substances (including hydrochloric acid, sulfuric acid, silane, perchloric acid, etc.)
- Poisonous substances such as potassium cyanide
- Oxidizing solids (chlorite, chlorate, perchlorate, peroxide, bromate, nitrate, iodides, permanganate, dichromate, etc.)
- Flammable solids (red phosphorus, sulfur, iron, metal powder, magnesium, other flammable solids, etc.)
- Pyrophoric materials and water reactive chemicals (potassium, sodium, alkylaluminium, yellow phosphorous, alkali metals and alkaline earth metals, organometallic compounds, metal hydride, metal phosphide, calcium or aluminum carbide, etc.)
- Flammable liquids (carbon disulfide, ethyl ether, acetone, gasoline, alcohol, kerosene oil, diesel, various paints and varnishes, and various oils such as heavy oil, creosote oil, gear oil, cylinder oil, edible oil, etc.)
- Self-reactive substances (organic peroxide, nitric ester, nitrous compounds, azo and diazo compounds, hydrazine derivatives, hydroxylamine, hydroxylamine salts)
- Oxidizing liquids (perchloric acid, hydrogen peroxide, nitric acid)
- Other substances suspected to be corrosive, explosive, flammable, and oxidizing
2.1.7 Items that May Interrupt Operations of the Venue or Competitions during the Championships
- Goods with sales purposes inside secured areas, banners, printouts, ropes, protest banners, clothing, etc. with phrases and paintings that express racial, religious, political or other propaganda that violate Championships rules, public, order, and common public sensibilities.
- Large flags (exceeding 2 meters long and 1 meter tall) and flags of non-participating countries as well as banners or markers containing commercial symbols or messages
- Light emitting devices including laser pointers, flash bulbs, etc.
- Instruments that may interrupt Games operations and spectators’ ability to hear (with sharp or loud sounds from cheering tools including small gongs, gongs, loudspeakers, vuvuzelas, and whistles)
- Wireless signal equipment (wireless controlling devices and their transceivers including radios, routers, jammers and drones)
- Various subsidiary equipment for movement such as bicycles, roller skates, skateboards, and folding chairs, mats, tents, etc.
- Sports accessories and equipment
- Large items unable to be screened such as large bags (over 50x50x50cm in size) and other large items that may interrupt spectators viewing of competitions
- Other items that may interrupt viewing of competitions
◇ Exceptions
- Banners for cheering that do not contain any racial, religious, political or other propaganda (within 2 meters by 1 meter in size)
- Equipment and supplementary materials for the movement of infants and those with disabilities
- National flags of the registered countries for the Championships (within 2 meters by 1 meter in size)
- Items sold and provided at the official stores of Gwangju 2019 within Championships facilities
2.1.8 Pharmaceuticals
- Liquid pharmaceuticals more than 100ml in volume
- Pharmaceuticals less than 100ml in volume not visible in opaque or metal containers
- Over five(5) different types of pharmaceuticals in a sealed package
- Syringes or pharmaceuticals in aerosol form
◇ Exceptions
- Pharmaceuticals prescribed by a doctor with presentation of such documentation (signed or sealed with the name and address of the hospital or the doctor’s license number)
2.1.9 Others
- Pets
- Glass containers of all types
- Unidentified liquids, gels, creams, and powders inside opaque containers
- Beverages of any kinds (both alcoholic and non-alcoholic beverages)
- All liquids not otherwise exempted in this document
◇ Exceptions
- Service animals for the aid of people with limited mobility (including guide dogs for those with visual impairments)
- Cream, lotions, or oils up to 5 per person and personal hygiene goods contained in an original container, less than 200ml, and less than 1liter in total (glass containers are not allowed)
- Beverages (both alcoholic and non-alcoholic) sold and provided at the restaurant and official stores of Gwangju 2019 within Championships facilities
- Non-perishable food and beverages (not exceeding 1liter) in glass or thermal containers for patient, infants, and people proven to have medical conditions
2.2 Restricted Items
All spectators, including Ticket Holders, are allowed to bring into the Venues the following items in a restricted manner. Any spectator or Ticket Holder who is found to be in possession in violation of the restriction below will have the items seized (with no right to have the items returned), shall be removed from Venue and may be subject to arrest and/or prosecution by the relevant authorities. The list below represents a summary of restricted items and is subject to change at the discretion of Gwangju 2019. An updated, detailed list of restricted items can be found at the Gwangju 2019 Ticketing Website.
- Non-perishable snacks (not exceeding 1 liter) completely sealed or in airtight packaging for personal consumption
- Non-perishable food and beverages for consumption by infants and toddlers, patients, and Persons proved to have medical conditions
- Empty plastic water bottles to be filled with water inside the secured area (limited to 1liter clear water bottles without a brand name)
- Small folding umbrellas without sharp edges and without any manufacturer’s or supplier’s brand names visibly printed)
3. Obligatory and Forbidden Behavior
3.1 Prohibited Behaviors
3.1.1 Any behavior by a Ticket Holder that, in Gwangju 2019’s view, creates a dangerous situation, puts at risk an indiviudal’s personal security, is against public order, interferes in any way with the orderly execution of a Session or disrupts the enjoyment of a Sessions is forbidden and may result in a refusal of admission to or removal from Venue without refund.
3.1.2 The following is an illustrative list of prohibited and restricted behavior within any Venue, and is subject to change at the discretion of Gwangju 2019:
- Entering without a valid ticket or AD card or using a scalped ticket
- Throwing or launching materials into FOP(Field of Play) or seating areas, disturbing or interfering with event operations
- Blocking passages by sitting around gates, stairs, or in aisles without permission
- Climbing fences, light towers, or other facilities. Standing on the seats.
- Smoking in non-designated areas
- Entering a prohibited area without permission
- Destroying or invalidating seals placed by Government Securities or Gwangju 2019 Security Team without permission
- Threatening, overpowering, insulting, or provoking others including referees, athletes, staff, and operational crews
- Building tents, cabins, or similar objects
- Entering the facilities under the influence of alcohol
- Entering the facilities under the influence of drugs
- Soliciting, making speeches, assembling, propagating a religion
- Using fire from sources other than lighters in designated smoking zones
- Cars entering into or parking in undesignated areas
- Distributing, posting or damaging advertising materials, fundraising
- Dumping trash or other waste in undesignated areas
- Disturbing the Championships or causing harm to facilities and spectators
3.1.3 All Ticket Holders Also Shall Not:
- Undertake any form of ambush marketing, which shall include any activity, whether commercial or non-commercial, that creates, implies or refers to a direct or indirect association of any kind (including the public to make such associations) with the Championships or Championships Body (Gwangju 2019, FINA, CA or of any other official Swimming Body).
- Cause to be done, or permit anyone to do, anything which might damage or endanger the validity or distinctiveness of, or the goodwill in, the Protected Marks of any Championships Body: or
- Conduct or behave in a manner that may harm or have adverse effect on the good will or goodwill associated with the Protected Mark (emblem, mascot, title, etc.).
3.2 Compulsory Behaviors
3.2.1 A Ticket Holder’s breaching the following may result in a refusal of admission to or removal from the Venue without a refund.
- Presenting tickets, identification card, or AD cards on request
- Cooperating with safety searches of personal belongings
- Observing Venue protocols and the security crew’s instructions
- Sitting in designated Venue seat or area as printed on Ticket (if ticket only assigns designated area, sit in seats of said area). Standing in aisles or on stairs during Session is not permitted and Ticket Holder may be asked to return and sit in designated by operation crew.
4. Security Inspections
4.1 Gwangju 2019 may conduct security searches at Sessions
4.2 A Ticket Holder who rejects a security search or refuses to comply with rules and security notices published by Gwangju 2019 will be required immediately to leave Veue, without refund to the Ticket Holder or Ticket Purchaser
5. Filming, Photography & Taping
5.1 Ticket Holders agree that the event for which Tickets have been purchased is public and that their appearance and actions inside and the perimeter of the Venue where the event occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at the event.
5.2 Ticket Holders agree to being photographed, filmed, identified and/or otherwise recorded by Gwangju 2019, FINA or third parties authorized by them, who, without payment, have the right to use any such photographs, films or recordings during and after the Gwangju 2019 Championships, for the maximum duration permitted under the applicable laws, in any content format and through any media or technology whether now existing or created in the future and whether such use is commercial or non-commercials.
5.3 Ticket Holders may capture or record still and moving images and sounds of the athletes and events within Venue and Ticket Holder agree that Gwangju 2019 and FINA shall be the sole owner of any intellectual property rights(including copyright) in such content without further authorization from, or compensation to, the Ticket Holder, or anyone acting on Holder behalf and hereby assign any rights Ticket Holder may have in respect of such content to Gwangju 2019 and FINA, including without limitation the right to make derivative works, waiving all moral rights of the same.
5.4 Pursuant to the above, FINA hereby grants to Ticket Holders with a limited and revocable license to use the still and moving images and sounds taken or recorded within Venues provided that such use is personal, private, non-commercial and non-promotional. Notwithstanding the foregoing, Ticket Holders shall not transmit such content over the internet, radio, television or any other media now known or hereafter invented, any moving images and sounds of the athletes and events taking place within the Venues (with such prohibition including without limitation, not posting such content on social media platforms), without FINA’s prior consent.
5.5 Ticket Holders are prohibited from using any electronic or communication device for the purpose of continually collecting, disseminating, transmitting or publishing any scores, statistics or other event data or information from events taking place within the Venues for any commercial, betting or gambling purposes.
5.6 In order to protect the privacy of residents in Host City, it is prohibited to take photographs within the “Photography Prohibited Area” or other designated photograph prohibited area as established by FINA or Gwangju 2019.
